Conditions of Use

BTI Biotechnology Intitute S.L., hereinafter BTI, offers this service subject to the following Conditions of Use.

These General Conditions of Use do not exclude the possibility that certain services or utilities offered through BTI’s content and general services website (located at URL http://www.bti-implant.es) are subject to certain special conditions of use, which, in any event, may be consulted by the Customer before their activation. The Customer assumes under their exclusive responsibility the consequences, damages or actions that could derive from access to said contents and from their reproduction or diffusion.

BTI will not be responsible for the infringements of any Customer that affect the rights of another Customer of BTI, or of third parties, including copyrights, trademarks, patents, confidential information and any other intellectual or industrial property rights.

This limited guarantee and the limitation of liability mentioned in the above paragraphs will not affect nor prejudice the imperative rights that assist them depending on their location of residence.

BTI will not be responsible for the technical availability nor for the content of the web pages that the Customer accesses by means of a link included in BTI’s portal. BTI will not be responsible for the damages caused to the Customer by the consultation or use of the contents or services offered by a website which has been accessed by means of a link included in BTI’s portal.

The Customer acknowledges that the elements and utilities integrated within BTI’s portal are protected by legislation on author’s rights and the intellectual and industrial property rights of the same correspond to BTI. As a result, the Customer agrees to respect the terms and conditions established by these General Conditions of Use, and will be the sole responsible for their infringement with regard to third parties.

The Customer acknowledges that the reproduction, modification, distribution, commercialisation, decompilation, disassembly, use of reverse engineering techniques or any other means to obtain the source code of the bar, the transformation or publication of any results of tests from unauthorised references of any of the elements and utilities integrated within the BTI portal are an infringement of BTI’s intellectual property rights, and is obliged, therefore, to refrain from any of the actions mentioned.

Likewise, the Customer acknowledges that the information they may access through the service may be protected by intellectual, industrial or other rights. Unless through a private agreement between the parties, the Customer undertakes to use said information exclusively for their own needs and to not directly or indirectly carry out a commercial exploitation of the services to which they have access or of the results obtained thanks to their use of the BTI portal.

The Customer shall abstain from carrying out any conduct on the BTI portal that infringes the intellectual or industrial property rights of BTI or third parties, or which violates or transgresses the honour, personal or family intimacy or the image of third parties, or which are illicit or are a crime against morality, and will in all cases hold BTI harmless against any judicial or extrajudicial claim made against it as a result of said use.

The Customer shall abstain from carrying out through the use of the BTI portal, any destruction, alteration, disablement or damage of data, programs or electronic documents belonging to BTI, its suppliers or third parties, or to insert or spread on the Net programs, viruses, applets, Active X controls or any physical or electronic instrument or device that causes or is susceptible of causing any type of alteration of the Net, the system or the equipment of third parties. Likewise, any type of activity or practice that transgresses the principles of good conduct generally accepted among Internet users is expressly forbidden.

BTI shall not be responsible for any damage caused to the user in the event of it being impossible to provide the service that is the subject of these General Conditions of Use due to possible unforeseeable circumstances, force majeure or other causes not attributable to the company.

Nor shall BTI be responsible for the inadequate operation of the BTI portal if it is due to maintenance work, to incidences that affect international operators, a faulty configuration of the Customer’s equipment or to their insufficient capacity to support the software systems that are essential to use the service.

BTI may unilaterally cease to provide the services offered by means of the BTI portal, where a mere communication to the Customer is sufficient, in the following hypothetical situations: unethical, offensive or incorrect use, and, in general, in the event that the Customer fails to comply with any of the obligations assumed by virtue of these conditions of Use
